Notification on Orissa 2018 list of holidays

Brief Highlights:

  • Applicability of the Act: The provisions of the Amendment Act shall apply to the establishments which employ ten or more workers, in contrast to the Act which applied to all establishments, irrespective of number of employees employed. However, establishments which employ less than 10 workers shall give intimation to Facilitator appointed under the Amendment Act by submitting online application, within a period of sixty days from the date of the commencement of this Act or the date on which establishment commences its business.
  • Appointment of Facilitators: The Amendment Act provides for appointment of facilitator who has powers to examine all the provisions as specified in all establishments.
  • Registration:   -       Registration under the Amendment Act has been made online.
  • Employers have to submit an online application within 60 days from commencement of the Amendment Act or commencement of business.
  • The term of registration certificate granted under the Act shall be for a period as requested by the applicant. However, such term shall not exceed 10 years.
  • The Amendment Act has introduced a new provision which provides that registration under the Amendment Act may be cancelled if registration is obtained through misrepresentation or suppression of material facts or by submitting false or forged documents or false declaration or by fraud.
  • As per this new provision under this legislation, increase in the working hours per day including spread over is 12 hours.
  • Introduction of 8 casual Leaves per year and one day paid leave for every 20 working days. Carry forward or accumulation of paid leaves shall not exceed 45 days.
  • Introduction of welfare provisions as per this new Act.

As per the provisions of Jammu and Kashmir Industrial Establishment (National and Festival Holidays) Act and the rules framed there-under it is the statutory obligation on the part of the employer that in each calendar year every employer shall frame and declare their employees one whole day as a holiday on 26th January, 13th July, 15th August, 2nd October and four other holidays. It is also the duty of employer to be display in the establishment on or before 31st December both in Local Language and English language on the Notice Board and in any other conspicuous place in the establishment.

The report aims to :
•Measure trends in hiring sentiment across the country, and estimate Job Growth, by city and sector.
•Drill across geographies, business size and hierarchy to provide additional dimensions of the statistic.
•Identify the key drivers of hiring sentiment at a ‘big-picture’ as well as sector-level.

Employment Outlook dips sharply, by 6 percentage points, for the forthcoming half year, April – September, 2017. Sectors are equally split between positive and negative hiring sentiment as they gradually recover from the after-effects of demonetization
•Sentiment is negative across geographies, but tier-2 cities more so (6 points down) than the rest. Employers are scaling down Entry (8 points down) and Mid level (5 points down) hiring quite drastically, and Senior level hiring is up significantly (5 points up).
•Large businesses are the least affected and are set to hire more during the coming half year (sentiment up 3 points), while the sentiment for small businesses is substantially down (10 points). Medium sized businesses plan to hire less as well (sentiment down 3points).
•IT, Engineering and Blue Collar roles gain prominence as sentiment for these improve by 4, 2 and 2 points respectively. Lesser Sales and Marketing jobs would be created over the next six months as employer sentiment is significantly down (7 and 5 points respectively).
•The Financial Services sector makes the most of the cashless environment with a 5 point increase in hiring sentiment. Healthcare & Pharma and Knowledge Process Outsourcing improve further (3points each) on their consistent track record. Construction & Real Estate and Manufacturing, Engineering and Infrastructure are the worst affected (8 and 5 points down, respectively).

Between 47 central labour laws and 200 state labour laws, India has an over regulated and poorly governed labour law system. These States are well positioned to reap handsome rewards from reforming their labour law regimes. At least 32 State and Union Territory governments submitted evidence of implementation of over 7000 reforms. A total of 6069 reforms were approved and implemented. The national implementation average has increased from 32% to 48.93%. The result of the assessment demonstrates that States have increasingly risen to addressing the challenge of making it easier to do business.
